Fraud

Each year, thousands of people fall victim to fraud. Rooting out fraudulent conduct and returning money stolen through fraudulent schemes is a core mission at Miner, Barnhill & Galland. Through its representation of state governments and individual clients who “blow the whistle” on deceptive or unfair practices, such as misleading statements, false or unfair prices, and coercion, MBG has returned hundreds of millions of dollars to taxpayers and individual victims of fraud. MBG attorneys have experience in litigating under consumer protection and false claim statutes to redress fraud in all its forms. If you have fallen victim to, or know of, a fraudulent scheme, contact MBG’s attorneys for a free consultation.

  • State and Local Government Representation

MBG has significant expertise in representing state and local governments that sue companies for violating consumer protection and anti-fraud laws. In recent years, a firm-wide team has represented the Attorneys General of seven states in “Average Wholesale Price” lawsuits against the nation’s largest pharmaceutical manufacturers that seek redress for damages to state Medicaid programs caused by publishing false and inflated prices for prescription drugs. This work recovered approximately $1.2 billion dollars for the firm’s state clients.

  • Consumer Protection

A variety of state and federal laws protect consumers of products and services from hidden charges and costs, false promises or a failure to perform as advertised. Harnessing these laws, MBG protects individual consumers who have been defrauded or harmed by unfair business practices. For example, the firm’s attorneys have challenged predatory lending practices, leading to large settlements in lawsuits brought across the country. Also using consumer protection laws, MBG has secured large settlements and verdicts for its clients by taking on the pharmaceutical industry’s pricing and off-label marketing practices.

  • Whistleblower Litigation (Qui Tam/False Claims Act)

“Whistleblowers” are individuals who bring lawsuits on behalf of the government to recover monetary damages against those whose fraud has cheated the government. In a successful lawsuit, the whistleblower is entitled to receive a percentage share of whatever funds are recovered by the government. MBG has successfully represented whistleblowers whose lawsuits have recovered tens of millions of dollars to compensate the government for fraudulent practices in health care, defense contracting and government-funded construction contracts.
