Grain Processing Corporation Class Action Settlement

Class Member Information

The Settlement Claims Administrator has completed a preliminary review of more than 6,000 settlement claims and, on October 28, 2019, mailed “cure letters” to those of you whose claims were missing some of the information the Settlement requires.

Be sure to watch your mail closely.  If the claim(s) you filed are missing information, the “cure letter” will tell you exactly what is missing and you will have 30 days to provide it—that is, postmark the response by November 27, 2019.  Otherwise your claim may be denied.

If you don’t get a letter, then this simply means the Administrator has all the information required.  (It does not necessarily mean the claim has already been verified, in whole or in part.)  The Settlement requires the Administrator to issue its determinations regarding whether to verify or deny each claim (including yours) after the “cure” process is completed.  If any part of your claim is denied at that time, you will be notified and given a right to appeal. The Administrator needs to wait until after both the cure process and the appeals process are completed before it can calculate payment amounts and begin issuing payments.

For now, it’s impossible for us to know how long this will take; but we’re hoping payments will be ready for distribution during the first half of 2020.

Thank you for your patience.
